Technical Assistance for the Drafting of Regulations for the Law of the Child Act

UNICEF Tanzania is seeking to contract a qualified and highly experienced international consultant to provide expert support for the drafting of the regulations for the Law of the Child Act.

1. Background
The Law of the Child Act was adopted in 2009. This was a major step in Tanzania's efforts to strengthen the protection for children's rights and to establish effective child protection and juvenile justice systems that comply with international standards. The challenge is now taking the law from paper to practice.

In order to operationalise the Act, the law envisages the development of a set of regulations addressing different aspects of the Act.

While the Ministry of Health and Social Welfare is mandated to develop the majority of these regulations, the issues to be covered by the regulations often go beyond the mandate of only one Ministry or Agency. Effective development and implementation of the regulations (and the LCA) relies on inter-agency cooperation.

In order to ensure inter-agency cooperation and input from all relevant MDAs for the development of the LCA regulations, the Technical Committee on LCA Regulation Drafting will be established. In addition, given the wide ranging nature of the regulations that need to be developed, five thematic Taskforces will be established to work on distinct sets of regulations: child care and protection; Local Government Authority child protection services; child rights; child labour and apprenticeships; and juvenile justice and child justice. National consultants with expertise in these specific areas will be recruited to provide direct technical support to the Task Forces.

2. Purposes and Objectives

The development of LCA regulations is a crucial step in the operationalisation of the provisions of the Act and therefore imperative for the implementation of children's rights, the child protection system and juvenile justice system in Tanzania.

The international consultant will be contracted to provide expert technical input into the development of regulations, to ensure regulations comply with international child rights standards and standards of good practice and to ensure overarching consistency and coherency.

3. Activities, deliverables and timeframe

The consultant will:
    * Provide guidance on the five thematic areas in terms of scope of the regulations, in light of the LCA and minimum requirements for child rights compliant legislation;

    * Provide 'best practice' examples of relevant legislation (focusing on secondary legislation) and examples of good practice processes for developing regulations from around the world and specifically Africa;

    * Review Task Force consultants' briefing paper which sets out the existing legal framework and proposals for drafting the regulations - scope, content, timeline - and provide written feedback;

    * Review the outline for the draft regulations from the Task Force groups and provide detailed written feedback and guidance;

    * Review draft regulations from the Task Force groups and provide detailed written feedback and guidance;

    * Ensure consistency and coherence between different thematic sets of regulations;

    * During the review process, ensure regulations are in line with international child rights standards and standards of good practice; and

    * Provide technical guidance for the development of a strategy for implementation.

4. Deliverables
Guidance document for the Task Forces including best practice examples with summaries for easy reference (Week 1-5)

Written response on Task Force Consultants' briefing papers (Week 3-7)

Written response on the outlines for regulations drafting (Week 6 & Week 9)

Written response to the draft regulations (Week 10-21)

The consultant is expected to provide written comment within 10 working days of receiving draft regulations on child labour and adoption and fostering and 20 working days of receiving other draft regulations.

Conference calls will be held on a monthly basis to discuss progress and provide support to the national consultants.

5. Time frame

The initial assignment is scheduled from February to July to support the first phase of regulations development and is likely to require 35 days work.

6. Qualifications and experience required:

    * Practicing Lawyer or Advanced Degree in Law

    * A minimum of 8 years of working with Governments to reform systems of child protection and/or juvenile justice (regional experience is desirable)
    * Demonstrable expertise in child rights, child protection and juvenile justice legal frameworks
    * Excellent drafting skills and demonstrable experience in drafting legislation (primary or secondary)
    * Excellent analytical skills
    * Excellent organisational skills
    * Excellent inter-personal skills
    * Fully computer literate
    * Fluent in English
